In increasingly global markets with high competition in the same products and services, "unregistered" trademarks are very weak.

The trademark is an important asset for your company and the right is only obtained with its registration. You do not obtain this right by having a web domain and/or social networks. Many pages in social networks and internet domains have been cancelled or the ownership has to be transferred to whoever has the registered trademark, thus losing time and money invested.

A registered trademark is an excellent investment and asset for your company, providing "added value", "exclusivity" and "monopoly" of its use in the country of protection. A trademark is regularly registered in most countries for 10 years and may be renewed for an indefinite period of time, as long as active use is demonstrated.

How to register a trademark?

A) FEASIBILITY STUDY
This report evaluates the feasibility and viability of the trademark registration. The same and/or similar trademarks will be evaluated in order to minimize the risks of oppositions or observations in the granting examination. This report will provide the "feasibility" of the trademark registration.

B) BRAND CLASSIFICATION
Trademarks are classified by products and services, so based on their use in the market, they must be protected.

C) TRADEMARK APPLICATION
The procedure will be requested online, registering previously as a User. Once registered you will choose the country where you wish to register the trademark, filling out the form, indicating the owners of the trademark, selecting the classes, and attaching the logo (in case the trademark contains a logo), if colors are protected it will be in colors, in case it does not have defined colors you may attach the image in grayscale. If the trademark application requests "international priority" (in case of having filed the trademark in another country before 6 months), it shall inform the requested dates and file number. The model of Power of Attorney to represent you will be previously sent to you so that you can sign, certify and legalize according to the requirements of the country of registration. Once the payment of services has been credited, we will proceed to file your application. If you want us to register your account and file your trademark application manually, there are no inconveniences, you only have to inform us in the consultation.

Note: If the brand has a logo, it must be attached in any of the following graphic formats: PNG, JPG or PDF brand manual in good quality.

D) PROCESS MONITORING
We will track and monitor new trademark applications that are filed during the registration process. If a trademark that may be confusingly similar to your trademark is applied for, you will be notified.

From the "client area" you will be able to follow up on the process initiated, receiving periodic notifications informing you of the status of the file. You will have at your disposal your digitalized documents, files, titles, certificates, payment receipts and invoices.

E) TRADEMARK REGISTRATION TIME
The process of registering a trademark may vary depending on the country where the application was filed, until it is granted. To cite some cases, in Argentina the time is 18 to 24 months, in Brazil 12-14 months, in the United States 12 to 14 months, in Peru and Chile 6-8 months, in Canada four years, considering that they are proceedings without oppositions or observations, so that if these events occur, the granting times may be extended until such events are resolved..

F) TRADEMARK TITLE OR CERTIFICATE
Once the resolution to grant the trademark is issued, the title or certificate will be requested, verifying its correct issuance. Subsequently it will be sent in digital file to your client area.

SUMMARY OF THE TRADEMARK REGISTRATION PROCESS

Once the application is submitted, it will enter the admission area, where it will be evaluated if the application meets the formal requirements.

Subsequently, it will be published in the bulletin, gazette or official media of the country (deadlines may vary depending on the country of application), where from 30 - 60 days after the day of publication, the opposition period will start. This period grants the possibility to a third party to oppose your application by legitimate right, if it considers that the filed trademark is confusingly similar.

If the trademark has no oppositions, it will follow its administrative course and registrability examinations, until it is granted. In case the trademark has any opposition, it will be negotiated with the opposing party in order to reach an agreement between the parties or it will proceed through the courts after analyzing the specific case.
