Information for registering trademarks in Cuba
- The registration of a trademark in Cuba is carried out at the Cuban Industrial Property Office (OCPI), an entity that belongs to the Ministry of Science, Technology and Environment (CITMA).
- Foreign applicants not established in Cuba must file their trademark application(s) through a Lawyer or Official Industrial Property Agent.
- The payment made in the trademark application, includes three (3) classes, the fourth (4) class, will pay additional rates and fees.
- The concession period for proceedings without opposition or observations is approximately 36 months.
- Once the trademark has been granted, official fees must be paid within 30 days of the granting of the trademark, the payment of which ratifies the registration of the trademark.
- A trademark is valid for 10 years from the date of registration and must be renewed within 6 months prior to the expiry of the registration. In case the renewal is not done on time, there is a grace period of 6 months to do it, this implies additional payments for the renewal process.
- Requires Power of Attorney with simple signature of the applicant.
