Trademark registration in United Arab Emirates

Requirements:

  1. A power of attorney duly legalized up to the UAE Consulate, which need to be submitted strictly within non-extendable 30 days from the date of first notification from the trademark office.
  2. A certified copy of the corresponding home or foreign registration or application (priority document) in case priority is claimed, which needs to be submitted strictly within 3 months from filing date.

Powers of attorney legalized at the UAE Consulates abroad must be super-legalized at the UAE Ministry of Foreign Affairs.

The cost of this super legalization is US$ 80 in case it bears consular stamps equivalent to 1000 or 2000 AE (equivalent to 272.50 or USD 545); however, if POA bears consular stamps equivalent to 100 or 200 AE (equivalent to USD 27.50 or 55) the cost of local super legalization will be US$ 600. 

As per the directives of the UAE TM Registrar, powers of attorneys executed in foreign countries (non- Arab) and priority documents have to be translated into Arabic language by a local certified translator even if power of attorney formats contain the Arabic version on the right side of the document.

The reason behind these recent directives is that clients in foreign countries sign the English part of the power of attorney and not the Arabic one.  With the introduction of the online services as of May 2015, it is allowed to file new trademark applications and obtain filing number and date with the official receipt confirming the filing particulars of the trademark without a copy of or original POA and the legalized POA sufficing local attestation and sworn Arabic translation can be submitted within 30 days from the date of first notification from the trademark office.; i.e., office action, conditional acceptance, rejection or the like.  

Time frame from filing a trade mark application up to registration, on average, in the case that no office action or oppositions are issued or lodged: 4 - 6 months.

  7. A certificate from the Censorship department of UAE Ministry approving the work according to regulations in virtue

*A copy of the online copyright application along with 2 CD should be submitted manually within 5 days from the date of online filing; otherwise, the application be considered as lapse.
