Trademark registration in Venezuela

1. We recommend: to carry out phonetic and graphic searches of the trademark antecedents of the signs to be protected previously. If the sign has elements composed of words and images, both searches must be performed. In order to request a feasibility report on the graphic background of the logos, an image of the sign in jpg or png format in good resolution quality (300 dpi) must be sent.
2. If it is proved that there is no trademark background on the sign to be protected in relation to the products or services to be distinguished, the trademark application will be filed.
3. Power of Attorney in favor of our attorneys is required, duly with the Apostille.
4. The trademark application must undergo a formal examination.
5. If these requirements are fulfilled, the trademark will be published in the digital press of the SAPI, a process established in the Venezuelan Industrial Property Law. 
6. If the application does not pass the formal examination, it is returned, which means that it must be corrected or subsumed as requested by the SAPI, once the application is corrected, the trademark is published in the digital press.
7. Opposition period: 30 working days from publication.
8.  Finally, once the granted trademark registration is published in the Industrial Property Bulletin, there are 30 working days to make the payment of the registration fees, step in which the trademark is definitively registered and a registration number is assigned.
9. Approximately 90 days after payment of the fees, the trademark registration certificate can be downloaded.Important: If the trademark registration fees are not paid within the indicated term, the application will be declared invalid and the entire process will be lost.
10. Administrative time of concession: 12 to 18 months, of a normal process without observations, oppositions or requirements of the SAPI.

12. Years of trademark concession: 15 years renewable from 9 months after expiration.
13. Trademark renewal: for 15 years.
