Foreign applicants must appoint a local attorney or agent. The process includes a formal examination, publication with a 60-day opposition period, and substantive examination. Brazil adopted the latest version of the Nice Classification in January 2026.

Trademark protection is obtained by registration in Brazil, but there are exceptions, such as the registration of foreign before well-known trademarks in the same field that are similar, imitation or translation of a national application, may invalidate the trademark registered in Brazil, according to Article 6 bis, Paris Convention.

Procedure trademark registration in Brazil

The application process includes a formal examination and a distinctiveness examination, and a search for prior trademarks. It takes approximately 3 years from the first filing to registration or the first office action. Prior to registration, the trademark application is published approx. 3 months after the application date in the weekly "Revista de la Propiedad Industrial". The opposition period is 60 days from the date of publication of the application.

Duration

A trademark registration in Brazil is valid for 10 years from the date of grant and has protection from the date of application/filing. The registration is renewable for periods of 10 years.

Classification of Goods / Services: 

  • International Classification, (Nice Classification is used in Brazil).
  • Priority claim under the Paris Convention: Yes. 
  • Registrable: Trademarks, service marks. 
  • Time until issuance of the registration certificate: 40 months. 
  • Opposition period: 60 days. 
  • Renewal application: Within 12 months before expiration. 

Use: When a registered trademark has not been used continuously for the goods or services in question for 5 years from the date of registration (or the date of last use), a cancellation action may be filed by an interested person. 

As from January 1, 2007, the goods and services will be specified in accordance with the standard articles of the International Classification of Goods and Services of the Nice Classification in its ninth edition (WIPO).  The trademark registration in Brazil, pays values at the beginning of the trademark application and when it is granted, the title is requested where the values of its management are paid.

The fees for the registration of trademarks in Brazil are in two stages

  1. Payment of trademark application fees, fees and expenses when filing a trademark application in Brazil.
  2. Payment of taxes, fees and expenses for the granting of the trademark in Brazil, issuance of title and custody for 10 years (approximately 24 months of a normal procedure, without oppositions or observations from the INPI).
